Homeowner vs. Wells Fargo Bank & Freddie Mac. Riverside Superior Court case #RIC 10013621.
SLG represents a homeowner who purchased a new condominium from a builder that had a joint venture relationship with Wells Fargo Bank. After 18 months of on-time payments, a school tax appeared that raised the monthly payments over 25% which pushed the payments beyond our clients ability to pay. After discussing the matter with Wells, our client was told to become delinquent in the payments in order to qualify for a loan mod. Wells told them the loan modification was approved and 8 timely payments were made only to learn that Wells had entered the income data wrong in their system which caused Wells to cancel the modification and seek a foreclosure. The Court granted our Temporary Restraining Order. After 7 months of litigation, Wells finally performed and gave our client a permanent modification. The case is still pending againt Wells and the builder for damages.
Homeowners vs. Fannie Mae & Cendant (PHH) Mortgage. Orange County Superior Court Case #30-2010-00-00408093.
SLG represents a married couple who thought they had obtained a loan modification, was told by the bank that they had obtained a loan modification, and after paying 12 consecutive monthly payments pursuant to the modified loan PHH mortgage foreclosed on their home without any legal authority to do so and transfered it to Fannie Mae.
